A trademark is a word, phrase, symbol or design, or a combination of words, phrases, symbols or designs, that identifies and distinguishes the source of the goods of one party from those of others. A trademark need not be registered in order to have protectable rights to it, simply by using or displaying a mark acquires automatic trademark rights to the owner.

Licenses must be obtained for the use of any BYU trademark, image, or photograph used on any packaging (including hangtags and stickers), signage, or product sold to the general public or to campus departments and organizations. In addition, promotional licenses must be obtained by companies or organizations wanting to associate with the University through any use of its trademarks.
Consumers, fans, and institution supporters should look for the Officially Licensed Collegiate Product (OLCP) hologram label. All Collegiate Licensing Company (IMGCL) institutions require the use of an OLCP hologram label on their products. This authenticator assures the consumer that the product they are buying is officially licensed and approved by the institution(s). If a collegiate product does not include the OLCP hologram label, consumers should be skeptical, although sometimes hangtag and stickers can fall off of a product or smaller products are sometimes exempted from label use. The IMGCL recommends looking at other collegiate articles in and around the product in question. If the other products are not properly tagged, we recommend that the consumer contact the IMGCL via the "Report Infringers" subsection of the "Resources" section of www.clc.com so that the issue can be investigated.
